General Terms and Conditions of the CredoWeb Platform

1. Welcome to CredoWeb

Our mission

CredoWeb’s mission is to connect all participants in the field of healthcare (patients, medical professionals, companies). The platform offers diverse communication tools and solutions to all users and aims to be a digital space where users exchange quality medical information.

2. Agreement

Please be informed that by using, accessing and/or registering to this website and our services, you are entering into a legally binding agreement (even if you are using our Services on behalf of a company).

a) When you use the Services of www.credoweb.in, you enter into a legally binding agreement with CredoWeb EOOD.( from here on CredoWeb);

b) This “Agreement” includes these Terms & Conditions, the Privacy policy, the Cookie policy and other terms that will be displayed to you at the time you first use certain features, as may be amended by CredoWeb from time to time. If you do not agree to this Agreement, do NOT register and do NOT access or otherwise use this website and any of our Services;

c) This Agreement applies to both registered users of our Services referred to as “Members” and unregistered users - “Visitors”. The term “User” ”applies to both Members and Visitors;

d) To use the Services, you agree that you must be the “Minimum Age”. “Minimum Age” means the minimum age according to your local legislation. However, the Services are not for use by anyone under the age of 14.

3. CredoWeb cares about your personal data

When you register as a member of the CredoWeb platform, you give your explicit consent for collecting of your personal information including its using by CredoWeb within these Terms and Conditions and the separate Privacy Policy that you should read carefully.

CredoWeb shall take all reasonable and lawful efforts to protect users’ personal information.

Upon creation of your CredoWeb Platform account, you may choose to enter additional information providing description of your expertise and experience or to start following other users or posting content. Providing this additional information may give you more benefits from using our Services and thus enable us to serve you more relevant content and ads.

In addition, by using the CredoWeb Platform you give your consent to the use of cookies in your browser. More information about cookies can be found in point 4.

4. Cookies

Cookies are small text files that are stored by your browser on your computer hard drive. The cookies used by CredoWeb don’t store any personal data.

5. Obligations

5.1. Membership

These rights and obligations apply to all members and all types of user profiles available on the CredoWeb Platform – personal profiles, professional profiles and company profiles.

a) Your membership profile in the CredoWeb Platform is free. Premium Services are available to some user profiles and might require payment. CredoWeb will inform you about any applicable charges before you commit to any Premium Services and you have the right to decide not to commit to these Services.

b) To become a Member of the CredoWeb Platform you will fill out a registration form providing CredoWeb with your Personal Data (name, surname, e-mail address, birthday, gender and password) and will agree with these Terms & Conditions. Additional information might be required if you are registering with a professional or company profile.

c) You will not create more than one personal profile on the CredoWeb Platform and will not create a false identity on the CredoWeb Platform.

d) You will provide accurate information on your profile and keep it updated through the entire duration of your membership.

e) You will not create a profile for or use the profile of anyone other than yourself without permission.

f) If CredoWeb disables your account, you will not create another one without our permission.

g) You will not share your password or do anything else that might jeopardize the security of your profile.

h) You will not transfer your profile (including any Page) to anyone without first getting our written permission.

i) If you select a name or similar identifier for your profile or Page, we reserve the right to remove or reclaim it if we believe it is inappropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).

j) You agree to use the CredoWeb Platform in a respectful manner and will not post inappropriate, inaccurate, or objectionable content.

k) If you are a having a professional or company profile you are obliged to follow all applicable professional codes of conducts when using the CredoWeb Platform and Services.

l) You will not misrepresent your current or previous positions and qualifications, affiliations with a person or entity.

m) You will not send spam or other unwelcomed communications to others.

n) You will not act in an unlawful, libelous, abusive, obscene, discriminatory or otherwise objectionable manner.

o) You will not post any unsolicited or unauthorized advertising, “junk mail”, “spam”, “chain letters”, “pyramid schemes” or any other form of solicitation unauthorized by CredoWeb.

p) You agree that CredoWeb reserves the right to transfer its rights and obligations with respect to users partially or completely to a third party.

You have the right to terminate this Agreement at any time in accordance with p. 9 Termination of this Agreement.

You are responsible and liable for all information, content and actions connected to your profile. If you suspect that someone is trying to jeopardize your profile, you are obliged to inform CredoWeb immediately.

Professional and Company profiles undergo a verification process by CredoWeb. However CredoWeb cannot guarantee the identity of all profiles using the Platform. You are liable for damages caused if you claim a professional or company profile without having the right to do so.

5.2 Notices, Service Messages and Advertisement

You agree that we may provide notices to you in the following ways:

(1) a banner notice on the Platform, or (2) an email sent to an address you provided, or (3) suggested posts on the Platform, (4) through other means including mobile number, telephone, or mail. These notices could contain commercial information. You agree to keep your contact information up to date.

To control and limit what kind of messages you receive from us per e-mail, please review your profile settings.

You agree that CredoWeb has the right to serve you commercial information on the Platform and that you will not remove, cover or obscure any advertisement included on the Platform.

5.3. Messages and Sharing

Our Services allow messaging and sharing of information in many ways, such as your profile, content (articles, status posts, comments, galleries, shares) and internal messaging. Information and content that you share or post may be seen by other Members or, if public, by Visitors. Where there are settings provided, CredoWeb will honor the choices you make about who can see content or information. Please note that some Services are by default private and only visible to the addressee(s).

CredoWeb is not obligated to publish any information or content on our Platform and can remove it in our sole discretion, with or without notice.

5.4. Safety

CredoWeb aims to keep its Platform safe, but cannot guarantee it. Users are obliged to help in keeping the CredoWeb Platform safe to the best of their ability:

a) You will try to keep your profile safe: (1) try to choose a strong and secure password; (2) keep your password secure and confidential; (3) report any suspicions that someone has or is trying to get access to your profile; (4) report any suspicions that someone is or is trying to jeopardize the safety on the CredoWeb Platform.

b) You will not post unauthorized commercial communications (such as spam) on the CredoWeb Platform.

c) You will not collect users' content or information, or otherwise access the CredoWeb Platform, using automated means (such as harvesting bots, robots, spiders, or scrapers) without CredoWeb’s explicit consent.

d) You will not engage in unlawful marketing, such as a pyramid scheme, on the CredoWeb Platform.

e) You will not post anything that contains software viruses, worms or any other harmful code.

f) You will not solicit login information or access a profile belonging to someone else.

g) You will not harass, abuse or harm other Users.

h) You will not use the CredoWeb Platform to do anything unlawful, misleading, malicious, or discriminatory.

i) You will not do anything that could disable, overburden, or impair the proper working or appearance of the CredoWeb Platform, such as a denial of service, attack or interference with page rendering or other CredoWeb Platform functionality.

j) You will not engage in “farming”, “mirroring” or otherwise simulating the appearance or function of the Platform.

k) You will not (1) imply or state that you are affiliated with CredoWeb; (2) rent, lease, loan, trade, sell access to the Platform or related data; (3) or monetize CredoWeb Services or any other feature of the Platform without CredoWeb’s explicit consent.

l) You will not deep-link to our Services for any purpose other than to promote your profile or Page on the CredoWeb Platform, without CredoWeb’s explicit consent.

m) You will not facilitate or encourage any violations of this Statement or our policies.

5.5.Protecting other User’s rights

Users are obliged to respect and protect other CredoWeb Platform users’ rights:

a) You will not post content or take any action on the CredoWeb Platform that infringes or violates someone else’s rights or otherwise violates the law.  

b) You will not copy or use information, content or data of other users available on the CredoWeb Platform if you do not have the explicit consent.

c) You will not remove any copyright, trademark or other proprietary rights notices contained in content on the CredoWeb Platform.

d) You will not disclose information that you do not have the right to disclose, violate intellectual property or other rights of CredoWeb or other people or companies without their explicit consent.

5.6. Intellectual Property Rights

CredoWeb reserves all Intellectual Property rights on the Platform (including logos and other trademarks, service marks, graphics or registered trademarks of CredoWeb, technical or intellectual know-how):

a) You will not use CredoWeb’s copyrights or Trademarks or any confusingly similar marks, except with our prior explicit written consent.

b) You will not copy or use information, content or data on the CredoWeb Platform except with our prior explicit written consent.

c) You will not copy, modify or create derivative works of the CredoWeb Platform, the Services or any related technology except with our prior explicit written consent.

d) You will not do reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Platform or any related technology or any part thereof.

e) You will not remove any CredoWeb copyright, trademark or other proprietary rights notices contained in or on our Platform or content within the Platform.

6. Rights and Limits

6.1. Sharing your content on the CredoWeb Platform

As between you and CredoWeb, you own the content and information that you post to the CredoWeb Platform and you control who sees your content using the targeting options when publishing information (e.g. articles, status updates, events, contact information). You are only granting CredoWeb a non-exclusive license for a worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish, and process, information and content that you provide through CredoWeb’s Platform, without any further consent, notice and/or compensation to you or others. These rights are limited as follows:

a) You can end this license for specific content by deleting such content from the CredoWeb Platform, or generally by closing your profile in the CredoWeb Platform, except (a) to the extent you shared it with others as part of the Platform and they copied or stored it and (b) for the reasonable time it takes to remove from backup and other systems.

b) CredoWeb will not include your content in advertisements for the products and services of others (including sponsored content) to others without your separate consent. However, we have the right, without compensation to you or others, to serve advertisement near your content and information.

c) CredoWeb will get your consent if CredoWeb wants to give others the right to publish your content beyond the Platform. However, other Users may access and share your content and information, consistent with the visibility you have given your content on the CredoWeb Platform.

d) While CredoWeb may edit and make formatting changes to your content (such as translating it, modifying the size, layout or file type or removing metadata), CredoWeb will not modify the meaning of your expression.

In order to keep content in the CredoWeb Platform relevant to Users and in accordance with applicable law, you agree to the following terms:

a) CredoWeb may access, store and use any information that you provide in accordance with these Terms and Conditions.

b) The CredoWeb Platform is a healthcare social media and content on it should be related to healthcare topics only.

c) Only provide content or information if that does not violate the law nor anyone's rights (e.g., without violating any intellectual property rights or breaching a contract).

d) Applicable law may not allow advertisement of prescription drugs to the general public. You agree that if you publish content or information about prescription drugs, you will target this only to medical professionals. If you are not sure if your content or information is about a prescription drug, what constitutes as advertisement or how to target your content correctly, you can contact CredoWeb.

e) You also agree that your profile information will be truthful. CredoWeb may be required by law to restrict and/or remove certain information or content from the Platform.

f) By submitting suggestions or other feedback regarding our Services to CredoWeb, you agree that CredoWeb can use and share (but does not have to) such feedback for any purpose without compensation to you.

6.2. Other Content

By using the CredoWeb Platform, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. CredoWeb generally does not review content provided by our Members. You agree that we are not responsible for third parties' (including other Members') content or information or for any damages as result of your use of or reliance on it.

6.3. Limits

CredoWeb has the right to change, suspend or end any Service. CredoWeb is not obliged to store, maintain or provide you with a copy of any content or information that you or others have posted on its Platform.

CredoWeb reserves the right to limit your use of the Platform, including the number of your contacts and your ability to contact other Members. CredoWeb reserves the right to restrict, suspend, or terminate your profile if CredoWeb believes that you may be in breach of this Agreement or law or are misusing the Platform.

CredoWeb Platform may contain information in the field of healthcare. Howerver, CredoWeb do not recommend any treatment or give any medical advice. For any of your medical conditions, you need to seek an advice from a licensed medical professional.

7. Disclaimer and Limit of Liability

WE TRY TO KEEP THE CREDOWEB PLATFORM UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING THE CREDOWEB PLATFORM ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE CREDOWEB PLATFORM WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT THE CREDOWEB PLATFORM WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. CREDOWEB IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.

TO THE EXTENT PERMITTED UNDER LAW (AND UNLESS CREDOWEB HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT SUPERSEDES THIS AGREEMENT), CREDOWEB (AND THOSE THAT CREDOWEB WORKS WITH TO PROVIDE THE SERVICES) SHALL NOT BE LIABLE TO YOU OR OTHERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES, RELATED TO THE SERVICES (E.G. OFFENSIVE OR DEFAMATORY STATEMENTS, DOWN TIME OR LOSS, USE OR CHANGES TO YOUR INFORMATION OR CONTENT).

APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

8. Amendments

CredoWeb will notify you before we make changes to these terms and give you the opportunity to review and comment on the revised terms before continuing to use our Services. If you do not agree to these changes, you must stop using the Platform and terminate your Membership in accordance with p. 9 Termination.

Your continued use of the CredoWeb Platform, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.

9. Termination

9.1. Termination by you

You may terminate this Agreement at any time simply by stopping to use our Services and/or terminate your account by sending an email to support@credoweb.in. On termination, you lose the right to access or use the Platform.

9.2. Termination by CredoWeb

CredoWeb may terminate this Agreement by sending an email to you in the following cases:

a) If CredoWeb stops operating the Platform.

b) If CredoWeb believes you provide untruthful information on your profile or in your content, or that you are below the “Minimum Age” to use the Platform.

c) If CredoWeb believes you are violating your Membership obligations.

d) If CredoWeb believes you are violating other people’s rights or jeopardizing the safety of the CredoWeb Platform or others.

e) If you are using Premium-services and you have failed to pay the applicable fees as provided by your separate written agreement.

f) If you violate these Terms and Conditions in any other way.

9.3. The following may not be affected by the termination:

a) Our rights to use and disclose your feedback;

b) Users rights to further re-share content and information you shared through the Platform to the extent copied or re-shared prior to termination;

c) Points 6, 9 and 10 of this Agreement;

d) Any amounts owed by either party prior to termination remain owed after termination.

10. Dispute Resolution

a) All provisions shall be governed by the Bulgarian law without regard to provision of conflict of laws.

b) Any dispute with regard to these Terms and Conditions shall be amicably solved and it shall be decided in accordance with the law of India.

c) If anyone brings a claim against CredoWeb related to your actions, content or information on the CredoWeb Platform, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
